1. Acceptance of Terms
By accessing or using JewelAI (“the Platform”), you agree to be bound by these Terms & Conditions. If you do not agree, you may not use the Platform. These terms apply to all users, including store owners, staff members, and end customers who receive communications through the Platform.
2. Description of Service
JewelAI is a cloud-based management and point-of-sale platform designed for jewelry and watch stores. The Platform provides inventory management, repair tracking, customer relationship management, payment processing, and communication tools including email and SMS notifications.
3. Account Registration
- You must provide accurate and complete information when creating an account.
- You are responsible for maintaining the security of your account credentials.
- You are responsible for all activities that occur under your account.
- You must be at least 18 years old to create an account.
- One store may have multiple staff accounts with varying permission levels.
4. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose or in violation of any applicable laws.
- Send unsolicited or unauthorized communications (spam) through the Platform.
- Attempt to gain unauthorized access to other users' accounts or data.
- Interfere with or disrupt the Platform's infrastructure or services.
- Use the Platform to store or transmit malicious code.
- Resell, sublicense, or redistribute access to the Platform without authorization.
5. SMS & Email Communications
- Store owners and staff are responsible for obtaining proper consent from customers before sending SMS or email communications through the Platform.
- SMS messages are sent via Twilio and are subject to carrier fees and regulations. Standard message and data rates may apply to recipients.
- Email communications are sent via Resend from the noreply@jewelai.app address. Replies to this address are not monitored.
- Customers may opt out of SMS at any time by replying STOP. Store owners must honor all opt-out requests.
- The Platform is not to be used for bulk unsolicited marketing. Communications must be transactional or based on an existing customer relationship with explicit consent.
5a. SMS Terms
By opting in, you agree to receive text messages from JewelAI and/or the jewelry store servicing your repair. Messages may include repair intake confirmation, repair status updates, estimate approval requests, pickup reminders, and completed repair notifications.
Message frequency varies based on repair activity. Message and data rates may apply. You may opt out at any time by replying STOP. For help, reply HELP or contact support through JewelAI.app. Consent to receive SMS messages is not required to purchase goods or services.

6. Payment Processing
Payment processing is facilitated through third-party providers (Square, Stripe, Affirm). JewelAI does not store credit card numbers or sensitive payment credentials. All payment processing is subject to the respective provider's terms of service. JewelAI is not responsible for payment disputes, chargebacks, or processing errors handled by these providers.
7. Data Ownership
- Store owners retain full ownership of their business data, including customer records, inventory, orders, and repair history.
- JewelAI does not claim ownership of any data entered into the Platform by users.
- Upon account termination, store owners may request an export of their data. Data will be retained for 30 days following account closure, after which it may be permanently deleted.
8. Subscription & Billing
- Access to the Platform requires an active subscription plan.
- Subscription fees are billed in advance on a monthly or annual basis via Stripe.
- Failure to pay may result in suspension or termination of access.
- Refunds are handled on a case-by-case basis at JewelAI's discretion.
- Pricing is subject to change with 30 days' prior notice.
9. Limitation of Liability
JewelAI is provided “as is” and “as available” without warranties of any kind, either express or implied. To the fullest extent permitted by law, JewelAI shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, regardless of the cause of action.
10. Indemnification
You agree to indemnify and hold harmless JewelAI, its officers, directors, and employees from any claims, damages, or expenses arising from your use of the Platform, your violation of these Terms, or your violation of any rights of a third party.
11. Termination
JewelAI reserves the right to suspend or terminate your access to the Platform at any time for violation of these Terms or for any other reason at our sole discretion. You may cancel your account at any time through the Platform or by contacting support.
12. Changes to Terms
We may update these Terms periodically. Material changes will be communicated via email or through the Platform. Continued use of the Platform after changes constitutes acceptance of the updated Terms.
13. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of New York, without regard to its conflict of law provisions.
